Buying real estate in France
Conveyancing in France is transacted by a notary or notaire, an impartial public official not represented by either the vendor or the purchaser. It is therefore important for each party to appoint a solicitor or property lawyer fluent in your own language to look after his or her own interests.
The process is divided into two main stages.
Firstly, the various types of preliminary contracts are drawn up and can be prepared by either the notary or an estate agent. Sometimes notaries themselves act as estate agents. The preliminary contract is a binding written agreement by which you agree to buy the property. It is subject to conditions which, if not fulfilled, releases you from the contract. A 10 per cent fee is paid on signing the preliminary contract and this is followed by a seven day 'cooling off' period during which you may cancel the contract following the correct procedures. |

Secondly, there is a formal deed of sale called the acte de vente. This proves who owns the property and contains a detailed description of the property. The deed of sale must, by French law, be prepared and signed in front of a notaire.
